When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
Additionally, you agree not to:
The Service and its original content, features, and functionality are and will remain the exclusive property of GivingbackAI and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GivingbackAI.
User-generated content that you create, post, upload, share, or otherwise provide to the Service remains your intellectual property. By providing content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in any existing or future media.
Certain parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are typically set on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
Payment will be charged to your App Store/iTunes Account at confirmation of purchase. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Service.
Your Subscription will automatically renew at the end of each Billing Cycle unless you cancel it or GivingbackAI cancels it. You can cancel your Subscription renewal either through your online account management page or by contacting our customer support team.
Note to App Store Users: Your Subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, identifying the cost of the renewal.
You can manage or turn off auto-renewal for your Subscription at any time by going to your Account Settings on the App Store after purchase. No cancellation of the current subscription is allowed during the active subscription period.
GivingbackAI may, at its sole discretion, offer a Subscription with a free trial for a limited period of time. If you purchase a Subscription during a free trial period, any unused portion of the free trial will be forfeited.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you can initiate account deletion within the application's settings or simply discontinue using the Service.
In no event shall GivingbackAI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
GivingbackAI, its subsidiaries, affiliates, and its licensors do not warrant that:
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
Any disputes arising out of or related to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation, both parties agree to try in good faith to settle the dispute by mediation administered by a mutually agreed-upon mediator before resorting to arbitration, litigation, or some other dispute resolution procedure.
If mediation is unsuccessful, any controversy or claim arising out of or relating to these Terms or the Service shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall take place in [Your Jurisdiction], and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
